Terms of Service

These terms apply when you use birthdaygif.net ("BirthdayGIF", "we"). The site is run by Fanly, an individual based in Sihui, Zhaoqing, Guangdong, China. By using the site you agree to these terms. If you do not agree, please do not use it.

What we offer

You type a name, pick a look and a mood, and we make an animated birthday GIF with that name in the picture. The site also has ready-made birthday GIFs you can save and send.

The GIFs are drawn by an AI image model. Most come out well, but sometimes a letter is off or a detail looks odd. Check each GIF before you send it, and make another if you are not happy with it.

Free GIFs

Everyone gets two new GIFs a day without an account. The count resets at midnight US Eastern time. To keep this fair, the limit applies per device, per network (IP address) and per account, and there is a site-wide daily limit too. When the site-wide limit is reached, free GIFs pause until the next day. Getting a GIF that someone already made with the same name, look and mood is free and does not count.

Do not try to get around the limits, for example by using scripts, many devices or rotating IP addresses. We may block access that does.

GIF packs

You can buy a pack of new GIFs: 15 GIFs for $2.99 or 50 GIFs for $6.99 (US dollars, before any sales tax or VAT added at checkout).

• Each new GIF uses one from your pack. GIFs that already exist are free and do not use one.
• Packs are a one-time payment, not a subscription. Nothing renews.
• GIFs in a pack have no expiry date: unused ones stay in your account for as long as BirthdayGIF is running.
• A pack is for your own use and cannot be resold or transferred.

Purchases are processed by Waffo (Waffo Pancake), which acts as the merchant of record. Waffo is the seller on your receipt, handles payment and collects any tax due. Its own terms also apply to the payment.

Refunds

• Unused packs: if you have not made any GIF from a pack, you can get a full refund within 14 days of buying it. Email contact@birthdaygif.net with the email you paid with and the order date.
• Used packs: once a GIF has been made from a pack, that pack cannot be refunded.
• Failed GIFs: if a GIF fails for a technical reason on our side, the attempt does not count against your free GIFs or your pack. You do not need to ask; it is given back automatically.
• Refused names: if our image provider refuses a request because of its content rules, that attempt may count.
• Nothing here limits any refund right you have under the consumer law of the country you live in.

What you may type

Type first names, nicknames or family titles (Mom, Grandpa). Do not use the site to make GIFs that:

• name or depict a real public figure, or use a brand or a well-known character;
• insult, harass, threaten or sexualise anyone, or attack people for who they are;
• break the law or someone else's rights.

We filter some names automatically and may refuse or remove any GIF that breaks these rules.

Your GIFs

You may save, share and send the GIFs you make, and the ready-made GIFs on the site, for personal, non-commercial purposes such as birthday wishes on messaging apps and social media. Do not sell them, use them in advertising, or claim you drew them.

GIFs are not exclusive. Anyone who asks for the same name with the same look and mood gets the same GIF, and every finished GIF is reachable by its public link (see the Privacy Policy).

The site itself, its design, text and ready-made GIFs belong to us.

Accounts

You do not need an account to make free GIFs. If you create one, keep your sign-in details safe. You are responsible for what is done with your account. We may suspend accounts that break these terms.

Availability and liability

We work to keep the site running but cannot promise it will always be available or error-free. We may change or stop features at any time, including selling GIF packs or running the site itself. If we decide to close BirthdayGIF, we will post a notice on the site before it closes, so you have time to use the GIFs left in your packs.

To the extent the law allows, the site is provided "as is", and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.

Changes

We may update these terms. The date at the top shows the latest version. If a change matters for purchases you already made, the older terms keep applying to those purchases.

Law

These terms are governed by the laws of the People's Republic of China, without taking away any protection the consumer law of your own country gives you.
